|Marsh, Daniel||13H02418||Defendant was convicted of murdering an elderly Davis couple while they slept. Marsh was tried as an adult due to the heinous nature of his crimes. He was convicted of two counts of murder with special circumstance that include use of a deadly weapon, multiple murders, lying in wait, and torture. He was sentenced to 52 years to life in prison, however, due to Prop. 57, his conviction was conditionally reversed. He will be sent back to juvenile court for a transfer hearing where a judge will determine his suitability for juvenile court. If the judge determines that he is suitable for juvenile court, he could only be detained until he reaches the age of 25. A Court date has not been set yet in Yolo County Superior Court because the Appellate Court has not made a final decision yet as a result of the appellate attorney for the defendant filing a petition for review to the California Supreme Court for a different legal issue.||

|Defendant plead no contest to: 11380(a) HS, furnishing controlled substance to minor; 261.5(c) PC, unlawful sexual intercourse when minor is more than three years younger than the perpetrator; and 136.1(b)(2) PC, dissuading a witness. Defendant to be sentenced to a suspended 8 year, 8 month prison sentence; and five years formal probation; and no contact with the victim. Sentencing scheduled for 9/4/18.|

Issue concerning Defendant’s competence still undetermined. Sheriff did not transport Defendant to court. Court has appointed another doctor to evaluate Defendant. Further review of competency issue scheduled for 8/31/2018 at 8:30AM in Department 13.
