Sacramento County Man Convicted of Identity Theft
(Woodland, CA) – Yolo County District Attorney Jeff Reisig announced that on July 6, 2009, 42 year old David Nishioka entered a plea to Identity Theft, among other crimes. The charges in this case stemmed from a residential burglary in Sacramento where items including military ID, Driver’s Licenses and a checkbook were stolen. Then, 36 hours after that burglary Mr. Nishioka was in possession of those items at Cache Creek Casino.
Mr. Nishioka used the stolen identification at the casino to obtain $13,000 in credit in the name of the victim. When security realized Mr. Nishioka had used false identification and contacted him they also found him to be in possession of a concealed switchblade knife. “This is another case of a repeat felon committing Identity Theft, which could have cost a victim $13,000 or a nightmare trying to clean his credit,” said the prosecutor, Deputy District Attorney Clinton Parish.
Mr. Nishioka further admitted a prior conviction for a serious felony, Involuntary Manslaughter with the use of a weapon from 1989. In addition, Mr. Nishioka admitted four separate prison commitments. The prior conviction for a serious felony doubled the initial term; each prior prison commitment add one year.
While sentencing is scheduled to occur August 10th, 2009 in front of the Honorable Judge Thomas Warriner, Mr. Nishioka, his defense counsel and the prosecutor agreed to a term of 21 years four months in prison. “While this term is quite lengthy, Mr. Nishioka faced a possible 29 years to life because of his prior record, so we believe justice is served by this agreement,” said Deputy Parish.
Based on the 1989 conviction, as well as felony convictions in 1993, 1997, 1999, and the current charges, Mr. Nishioka has spent almost 13 of the last 20 years in custody for his crimes and has been convicted of nine felonies total.
